The rules for using Kindspan’s current free planning, account, tracking, and private record-organizing service.
The current service includes the website, a free starting plan, account tools, tracking, and private record organization. A preview is not a purchase.
Kindspan does not diagnose, prescribe, provide emergency care, or replace a veterinarian.
Only provide information and records you are authorized to use. Private uploads do not silently become confirmed facts.
These Terms of Service (“Terms”) are an agreement between you and Kindspan governing your access to and use of the Kindspan website, free Longevity Plan, account, dashboard, tracking tools, and record-organization features (together, the “Service”). “Kindspan,” “we,” “us,” and “our” refer to the operator of the Service under the Kindspan name.
You may browse public pages without an account. To create or save an account, you must be at least 18 years old, be legally able to enter this agreement, be located in the United States, and affirmatively accept these Terms and acknowledge the Privacy Notice. If you do not agree, do not create an account or use authenticated features.
If you use the Service for a dog owned or cared for by someone else, you confirm that you are authorized to do so and to provide the information involved.
Membership, diagnostic testing, supplements, partner services, or other capabilities labeled “coming soon,” “preview,” “demo,” or otherwise unavailable are not current offers and may change or never launch.
Kindspan provides educational and organizational decision support. It does not diagnose, prescribe, practice veterinary medicine, establish a veterinarian-client-patient relationship, provide prognosis, replace a veterinarian, or provide emergency services. A plan, tracker, explanation, source summary, alert, or extracted record value is not a diagnosis or treatment instruction.
Information depends on what you provide, available sources, and the product rules in effect. It may be incomplete, outdated, or unsuitable for a particular dog. Do not use Kindspan to delay professional care or to independently start, stop, or change medication, supplements, diet, exercise, rehabilitation, testing, or treatment.
If a dog may be experiencing an emergency or a new, severe, or rapidly worsening problem, contact a veterinarian or emergency veterinary service immediately. Do not use Kindspan for emergency communication.
Use an email address you control. You are responsible for safeguarding sign-in links and active sessions, keeping account information reasonably current, and notifying us promptly if you suspect unauthorized access. Do not share sign-in links or impersonate another person.
When household or caregiver access is available, authorized participants may see information associated with the dog and role. We may temporarily restrict access while investigating ownership, authorization, fraud, security, or account disputes.
You retain the rights you have in information and files you provide (“User Information”). You confirm that the information is accurate to the best of your knowledge, that you are authorized to provide it, and that doing so does not violate another person’s privacy, confidentiality, intellectual-property, contractual, or other rights.
Do not upload human medical records, payment-card information, government identifiers, passwords, credentials, or information unrelated to the dog’s care. Before uploading a veterinary record, you must confirm that you are the owner or authorized caregiver and are permitted to store and process that record.
You grant Kindspan and its service providers a limited, nonexclusive license to host, copy, secure, format, transmit, and otherwise process User Information only as reasonably necessary to provide, maintain, secure, support, and comply with law for the Service, subject to the Privacy Notice.
An uploaded record or extracted value does not automatically become a confirmed fact or change a plan. Kindspan may preserve owner-reported, measured, record-derived, and care-team sources—and any conflict among them—rather than selecting a winner.
The Service, including its software, design, plan structures, explanations, and Kindspan-provided content, is owned by Kindspan or its licensors and protected by applicable law. These Terms give you a limited, revocable, nonexclusive, nontransferable right to use the Service for personal purposes. They do not transfer ownership of Kindspan intellectual property.
If you voluntarily send product ideas or feedback, you permit Kindspan to use them without restriction or compensation. Private account information and dog records are not treated as feedback merely because they pass through the Service.
Kindspan will not begin a trial or charge you merely because you view pricing, choose a preference, request a plan, or create an account. A paid agreement begins only if Kindspan presents a working checkout and you expressly approve the price, trial terms, renewal frequency, first charge date, and cancellation terms immediately before submitting payment information.
If a card-required trial is offered, it converts to the displayed recurring price unless you cancel before the displayed deadline. You authorize the recurring charges only by completing checkout. You may cancel through the online account billing controls or the linked Stripe customer portal; cancellation ordinarily takes effect at the end of the current trial or paid period unless the checkout terms or applicable law say otherwise.
The exact checkout disclosure controls if it differs from an earlier preview. Taxes may apply. Except where required by law or expressly stated at checkout, amounts already charged are nonrefundable. We will give legally required notice before a material price change applies to a later renewal.
If no working checkout is presented, no paid membership, trial, renewal authorization, or charge has begun.
Kindspan uses service providers to host the Service, authenticate accounts, store data and files, deliver email, process payments when available, and support security and operations. We also link to external research, veterinary guidance, products, and websites. Third parties have their own terms and privacy practices.
A citation, external link, provider integration, or mention of a product does not mean Kindspan or a veterinarian endorses it. Kindspan does not control or guarantee third-party availability, accuracy, security, legality, or suitability.
Kindspan may improve, restrict, suspend, or discontinue part of the Service. We will provide notice when required by law or when a change materially affects an ongoing paid right. You may stop using the Service at any time and may request supported access, correction, export, or deletion as described in the Privacy Notice.
We may restrict or terminate access if you materially breach these Terms, create security or legal risk, misuse the Service, or if operation becomes unlawful or impracticable. Where reasonably possible and legally permitted, we will provide notice and an opportunity to obtain supported account information.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” KINDSPAN DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. KINDSPAN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT INFORMATION WILL BE COMPLETE OR CURRENT, OR THAT USE WILL PRODUCE A PARTICULAR HEALTH, LIFESPAN, FINANCIAL, OR OTHER OUTCOME.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINDSPAN AND ITS PERSONNEL AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINDSPAN’S TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID KINDSPAN FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not exclude liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or other matters where applicable law prohibits limitation. Your jurisdiction may give you additional rights.
Please contact hello@joinkindspan.com first so we can try to resolve a concern. These Terms do not require arbitration and do not waive any right to bring an individual or class claim that applicable law provides. A dispute may be brought in a court that has lawful jurisdiction.
These Terms and documents expressly incorporated into them are the agreement about the Service. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; Kindspan may transfer them with the relevant business, subject to applicable notice and privacy obligations.
We may update these Terms when the Service, law, or our operations change. We will revise the effective date and, when required, provide notice or request renewed agreement before the change applies. Material changes do not retroactively create a charge or reduce an already-accrued right.
